FLYING DRESSES NEW YORK — TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before booking a session with Flying Dresses New York. By completing a booking and submitting payment, you agree to be bound by these terms.
1. About Us
Flying Dresses New York is a photography experience company registered in the State of New Jersey. We provide flying dress photoshoot sessions in public spaces across New York City and the surrounding area, including New Jersey. Our services are offered through our website at flyingdressesnewyork.com.
2. Bookings & Payments
2.1 All bookings are confirmed upon receipt of full payment via Stripe through our website, or via cash where separately arranged. Regardless of payment method, a digital invoice or receipt confirming payment will be issued to the client’s email on file.
2.2 Prices are listed in US dollars and are subject to change at any time. The price displayed at the time of booking is the price you will be charged.
2.3 By completing a booking you confirm that you are at least 18 years of age, or that you have the consent of a parent or legal guardian if you are under 18. Clients under the age of 18 must have a parent or legal guardian complete and sign a consent form prior to the scheduled session.
2.4 Gift certificates are non-refundable and valid for 12 months from the date of purchase. They can be redeemed against any available package at the time of use.
2.5 Photoshoot experiences that have been completed are non-refundable.
3. Cancellation & Rescheduling Policy
3.1 More than 48 hours before your session: You may reschedule at no charge, or receive a refund minus a 10% booking fee.
3.2 Within 48 hours of your session: Your session may be rescheduled once at no charge. No refund will be issued.
3.3 No-show: If you do not show up for your scheduled session without prior notice, no refund will be offered. Reschedules will be offered with a surcharge of $200 to cover expenses of photographer and assistant.
3.4 Weather cancellation: Flying Dresses New York reserves the right to cancel or reschedule a session due to unsafe weather conditions, including heavy rain, high winds, or lightning. In this case, a full reschedule will be offered at no charge. We will contact you in advance if conditions are deemed unsafe.
3.5 Flying Dresses New York is not responsible for any travel costs, accommodation costs, or other expenses incurred by the client in connection with a cancelled or rescheduled session.
4. The Session
4.1 Sessions take place in public spaces in New York City and the surrounding area. Flying Dresses New York does not hold permits for any specific location. While we make every effort to shoot at your chosen location, we cannot guarantee exclusive access to any specific public space on the day of your session. Should a public authority restrict or prohibit photography at the scheduled location, Flying Dresses New York reserves the right to relocate the session to a comparable nearby location. This does not constitute a cancellation, and standard rescheduling terms (Section 3) do not apply in this circumstance.
4.2 Clients are responsible for arriving on time. Sessions will begin at the scheduled time regardless of late arrival. No extension of session time or refund will be offered for late arrivals.
4.3 Flying dresses remain the property of Flying Dresses New York at all times during the session, unless a rental has been separately agreed upon. Clients are responsible for any damage, staining, or destruction of the dress caused by negligence or misuse during the session. Damage will be charged according to Flying Dresses New York’s Dress Replacement & Repair Cost Schedule, available upon request. Normal wear consistent with typical photoshoot movement (e.g., minor dirt from ground contact) is not considered damage.
4.4 Flying Dresses New York reserves the right to end a session early if a client behaves in a way that is unsafe, disrespectful, or disruptive to the photographer, dress assistant, or members of the public.
5. Photo Delivery
5.1 All sessions include the number of professionally edited digital photos specified in your chosen package.
5.2 Edited photos will be delivered via digital download link within 5 days of your photo selection after the shoot.
5.3 Clients may request up to three (3) rounds of revisions per photo, addressing specific concerns such as contrast, shadows, unwanted objects, or color correction. Revision requests must be submitted within 5 days of photo delivery. Requests for entirely new edits, poses, or compositions beyond correction of the above elements are not included.
5.4 Flying Dresses New York will make every effort to deliver high quality images. However, we cannot guarantee specific results, poses, or outcomes, as photographic results depend on many factors including weather, lighting, and client participation.
5.5 Raw, unedited files are not included in any package.
6. Intellectual Property & Photo Usage Rights
6.1 Flying Dresses New York retains the copyright to all photographs taken during your session. Upon delivery of your edited photos, you are granted a non-exclusive, personal license to use, print, and share your photos for personal, non-commercial purposes.
6.2 You may not sell, license, or use your photos for commercial purposes without prior written consent from Flying Dresses New York.
6.3 Marketing Usage: By booking a session with Flying Dresses New York, you acknowledge and agree that we may use your photos for marketing and promotional purposes, including but not limited to our website, social media channels, advertising, and press materials.
6.4 Opt-Out: If you do not wish for your photos to be used for marketing purposes, you must notify us in writing before your session takes place. Once your session has been completed, this opt-out right expires.
6.5 Flying Dresses New York will never sell your photos to third parties.
7. Dress Rentals
7.1 Dress rentals are available for a 24-hour period and must be returned in the same condition as received.
7.2 The client is fully responsible for the dress during the rental period. Any damage, staining, or loss of the dress will be charged to the client at the full replacement cost of the dress.
7.3 Dress rentals are available for delivery within Manhattan only. Delivery terms and fees will be confirmed at the time of booking.
8. Liability
8.1 Flying Dresses New York is not liable for any injury, loss, or damage sustained by the client or any third party during a session.
8.2 Clients participate in flying dress photoshoots at their own risk. Flying dress photography involves physical movement and outdoor environments. Clients should ensure they are physically able to participate safely.
8.3 Flying Dresses New York is not responsible for any loss or damage to personal belongings during a session.
8.4 In the event that Flying Dresses New York is found liable for any claim, our maximum liability is limited to the amount paid by the client for the session in question.

10. Changes to These Terms
Flying Dresses New York reserves the right to update these Terms and Conditions at any time. The most current version will always be available on our website. Continued use of our services after any changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of New Jersey. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New Jersey.

13. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, while preserving its original intent as closely as possible.
14. Promotions, Discounts & Referrals
14.1 From time to time, Flying Dresses New York may offer promotional discounts, including but not limited to time-sensitive or seasonal pricing, newsletter signup incentives, or other marketing promotions. Unless explicitly stated otherwise, promotional discounts cannot be combined with any other discount, coupon, or offer, including the Referral Program described below. Where a client is eligible for more than one discount, only the single highest-value discount will be applied.
14.2 Newsletter Signup Discount. Clients who sign up for our newsletter may receive a one-time $50 discount. This discount may be combined with any other current promotion or discount, with the sole exception of the Referral Program described below.
14.3 Referral Program. Clients who refer a new customer may receive a $50 credit, and the referred customer will receive a $50 discount on their first session. Referral credits may be combined across multiple referrals (e.g., referring three new customers entitles the referring client to $150 in total credit). The Referral Program cannot be combined with any other discount or promotion, including the Newsletter Signup Discount.
14.4 Referral credits are issued only after the referred client’s photoshoot session has taken place. No referral credit will be issued for a session that is cancelled, rescheduled indefinitely, or refunded.
